What Victorian Law Requires Before You Hire
Victoria treats commercial cleaning differently from home cleaning, and the difference lands on the business paying for the service.
Under the Labour Hire Licensing Act 2018 (Vic), a business that supplies workers to clean commercial premises generally needs a labour hire licence. The rule cuts both ways. A business using those services must only engage a licensed provider. If your cleaner subcontracts the work, that subcontractor needs a licence too.
There are limits to the rule. A sole trader who cleans your office alone does not need one. Nor does a company with no more than two directors where those directors do the cleaning themselves and bring no other workers. Cleaning a private home is outside the scheme entirely.
The penalties are the part most business owners have never heard. A host business that enters an arrangement with an unlicensed labour hire provider faces penalties above $590,000. For an individual, the figure is above $145,000. That exposure sits with you, not with the cleaner.

The rules are also tightening. From 1 June 2026, changes under the Labour Hire Legislation Amendment (Licensing) Bill 2025 add further obligations for licensed providers, including declarations about financial position at application and renewal.
