How to check your cleaner holds a labour hire licence

Most business owners in Victoria have never checked this. It matters more than almost anything else on a cleaning quote. Under the Labour Hire Licensing Act 2018 (Vic), a business that supplies workers other than a director to clean commercial premises generally needs a labour hire licence. If you engage that business, you are a host. Hosts are only permitted to use licensed providers.

The Labour Hire Authority states that penalties exceeding $590,000 for businesses and $145,000 for individuals may apply where a host enters an arrangement with an unlicensed provider. Hosts can also face disruption if the Authority finds unlicensed workers have been supplied to their site. They can be liable for a provider’s breaches under workplace and migration law.

This is not a dormant rule. The Authority has named cleaners of commercial premises as a focus of an expanded compliance and enforcement program. It has said it is using data and intelligence to identify cleaning businesses that may need a licence, and it has fined operators. The Labour Hire Licensing Commissioner has warned that businesses hiding conduct through subcontracting will be identified.

Safety duty

Who carries the safety duty when a contractor is on site

Bringing in a contractor does not move your safety obligation onto them.
Under the Occupational Health and Safety Act 2004 (Vic), the duty sits with the business that manages or controls the workplace. That is you. The Labour Hire Authority makes the same point, stating that hosts share responsibility for workplace safety.

On a Dandenong South site that means real things, not paperwork. Forklift routes need exclusion zones while floors are being scrubbed. Plant should be isolated before anyone cleans around it. Chemical safety data sheets belong on site, not in a van. And in a precinct where the neighbouring units are locked and dark by 7pm, lone worker arrangements matter.
